Terms & Conditions
Goods mean the articles or things described in the contract between Goldhawk and the purchaser.
These conditions shall be deemed to be incorporated in all contracts of Goldhawk to sell goods and in the case of any inconsistency with any order or form of contract sent by the purchaser to Goldhawk whatever may be their respective dates the provision of these Conditions shall prevail unless expressly varied in writing and signed by a director on behalf of Goldhawk.
Notwithstanding that Goldhawk may have given a detailed quotation no order shall be binding on Goldhawk unless and until Goldhawk has accepted it in writing.
Any times or dates given for completion or delivery of goods shall be binding on Goldhawk, insofar as Goldhawk undertake to carry out additional work for the purchaser to the value of the print element of any goods not supplied on time. Such liability shall not extend to delays beyond the control of Goldhawk including, without prejudice to the generality of the foregoing defects in files or omissions of information delays in approval of proofs and non-performance of carriers.
By their nature goods do not have a redeemable value and no refunds or credits for goods correctly supplied will be entertained.
- a) All goods shall be paid for at the time of order.
- b) No goods shall be dispatched or collection allowed until paid for in full.
- c) All prices are exclusive of Value Added Tax and this will be charged at the appropriate rate where applicable.
- a) Any shortcomings or defects in goods supplied must be notified to Goldhawk within 3 days of delivery. Such goods must be returned to Goldhawk for inspection.
- b) Nothing herein shall impose any liability upon Goldhawk in respect of any defect in the goods arising out of the acts, omissions, negligence or default of the Purchaser, its servants or agents including without prejudice to the generality of the foregoing handling and storage of the goods.
- c) Nothing herein shall have the effect of excluding or restricting the liability of Goldhawk:
- i.) For death or personal injury resulting from its negligence insofar as the same is prohibited by U.K. statute, or;
- ii.) Under sections 12,13,14 and 15 of the Sale of Goods Act 1979 to a purchaser who is dealing with a customer (as defined by section 12 of the Unfair Contract Terms Act 1977).
Goldhawk shall not be liable for any costs, claims or damage arising out of any act of tort or omission or breach of contract or statutory duty calculated by reference to profits, income production or accruals or loss of such profits, income production or accruals or by reference to accrual of such, claim, damages or expenses on a time basis.
The liability of Goldhawk to the purchaser for any loss or damage of whatsoever nature and howsoever caused shall be limited to and in no circumstances exceed the price of the goods.
If the purchaser shall be in breach of any of their obligations under the contract Goldhawk may (without prejudice to Goldhawk’s rights subsequently to determine the contract for the same cause should it so decide) suspend further deliveries of goods without notice until any defaults by the purchaser are remedied.
No statement, description, information, warranty or recommendation contained in any catalogue, price list, advertisement or communication or made verbally by any of the agents or employees of Goldhawk shall be construed to enlarge, vary or override in any way these conditions.
Any concessions made or latitude allowed by Goldhawk to the purchaser shall not affect the strict rights of Goldhawk under the contract. If in any particular case any of these conditions shall be held to be invalid or shall not apply to the contract the other conditions shall continue in full force and effect.
Upon sight of artwork and at its sole discretion Goldhawk reserve the right to decline to print any item it deems to be inappropriate. Any payments made for work rejected by reason of this clause will be refunded in full.
The contract shall in all respects be governed by English law and shall be deemed to have been made in England and the purchaser and Goldhawk agree to submit to nonexclusive jurisdiction of the English courts.
Making a purchase could not be easier. Just browse our store, and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order.
We accept credit or debit card payment from Visa, Mastercard, Visa Delta, Maestro, Solo, and Visa Electron. For total security we only accept your card information using Protx, our secure Internet payment provider.
When confirmation of your order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.
Delivery Schedule
All completed orders are despatched using our next working day courier service. We deliver to the Mainland UK only and will require a signature so please ensure someone is available.
We do NOT deliver to Eire, Northern Ireland, Scottish Highlands, and Offshore Islands.
We do NOT deliver to PO box addresses.
Delivery times are between 9am and 6pm Monday to Friday.
Guarantee
At Goldhawk we strive for perfection. If on receipt of your print consignment you are anything less than delighted with the finished work please advise us straightaway. Your issue will be investigated urgently and quickly resolved. Where the problem is clearly something that can be attributed to Goldhawk we will immediately re-do the job, send out replacement printing, and recover the defective batch. In the event that re-printing is not an option we will instead either recover the defective work and credit you in full or, where appropriate, negotiate a partial credit to compensate for less than perfect but useable goods.
Where the cause of the problem cannot solely be attributed to Goldhawk we will seek to find a compromise remedy with you, either crediting the job in part or re-printing at a reduced cost.
Where the problem can be fully attributed to you, Goldhawk shall not accept liability in any part.
In the unlikely event that a satisfactory resolution can not be found between us, Goldhawk will accept the resolution recommended by a third party arbiter. The arbiter being an independent third person accepted by us both.
